The ill-fated collective proceedings over allegedly unlawfully inflated fares on the London to Brighton rail line have been decertified by the Competition Appeal Tribunal. The claim, filed in 2021, had a turbulent history including the death of the original class representative and a court battle between would-be replacements.
Boyle v Govia Thameslink Railway has been stayed since June last year when the original class representative, David Courtney Boyle, died from Parkinson's disease. A judgment published by the CAT this month reveals that no new class representative has emerged and the collective proceedings order has been revoked.
An update on the GTR Collective Proceedings website informs potential claimants that the proceedings have been decertified on the basis of a CAT order in April. A hearing to determine the parties' costs has been adjourned for the next available date after 6 November. 'Please note this website will be closed shortly,' the update concludes.

I have made a - fruitless - search of the Coffee Shop for a previous thread on this which as I recall involved ABC - the Association of British Commuters - I fee sure I should know what it's about already as it rings muffled bells, and I seem to be staring a thread very late in the day - or rather very late in the decade due to the (lack of) speed of legal activity.

Southern, Gatwick Express and Thamslink - each operating trains from Brighton to London - and perhaps misleading people by appearing to compete with each other? That's my reading of it but I could be wrong, and if I am, sorry for my misunderstanding - happy to add a correction.

Application by David Courtney Boyle and Edward John Vermeer to commence collective proceedings under section 47B of the Competition Act 1998. The proposed collective proceedings would combine standalone claims against the Proposed Defendants for loss and damage caused by alleged infringements of the Chapter II prohibition on abuse of dominance in section 18 of the Competition Act 1998.
A CMC took place on 16 December 2021.
A hearing to consider the Proposed Class Representatives' request to re-amend their collective proceedings claim form took place on 5 July 2022. The President issued his ruling in relation to this request on 5 July 2022 ([2022] CAT 30).
The CPO Application hearing took place on 13 to 15 July 2022. Judgment was issued on 25 July 2022. The Collective Proceedings Order was made on 5 October 2022.
A CMC took place on 14 October 2022. The President made a Reasoned Order in relation to costs on 28 November 2022 ([2022] CAT 54).
A CMC took place on 17 March 2023. The Tribunal issued a judgment dated 24 March 2023 vacating the trial listed for the last quarter of 2023, staying the proceedings (subject to a limited number of exceptions) and providing further case management directions ([2023] CAT 19).
A CMC took place on 12 October 2023. The Tribunal gave a ruling on the modality of trial on 19 October 2023.
